The seller or contractor for a particular Order is always the entity clearly identified to the Customer in the Offer and Order summary before the Order is placed.
The Seller may be:
Majko – usługi techniczne – Konrad Miłoń, details as above,
or
Roman Miłoń P.P.U.H. „PRO-TECH”
ul. Łukowa 2D
43-332 Pisarzowice
Poland
NIP: 9371675702.
Only the entity identified as the Seller in the accepted Offer is a party to the contract for the performance of that Order. The other entity mentioned does not become a party to that contract merely by virtue of operating the Website.
The Terms are available free of charge on the Website in a form that allows them to be saved and reproduced.
For the purposes of these Terms:
Website — the website available at majkocnc.eu.
Operator — the entity operating the Website.
Seller — the entity identified in a particular Offer and Order as the contractor or seller.
Customer — a natural person, legal person or organisational entity using the Website or entering into a contract.
Consumer — a natural person carrying out a legal transaction not directly connected with their business or professional activity.
Sole Trader with Consumer Rights — a natural person entering into a contract directly connected with their business activity where the contract is not of a professional nature for that person within the meaning of applicable law.
Business Customer — a Customer entering into a contract in the course of business or professional activity who does not benefit from the protection afforded to a Consumer in relation to that contract.
Documentation — in particular, 3D models, STEP, STP, STL, DXF, DWG and PDF files, technical drawings, photographs, descriptions, dimensions, tolerances and other information supplied by the Customer.
Enquiry — the submission of data and Documentation to obtain a quotation.
Offer — an individual proposal by the Seller specifying at least the subject of the performance and its price or the method of determining that price.
Order — an Offer accepted by the Customer and placed in a manner that creates an obligation to pay.
The Operator provides the following services electronically, in particular:
- making the Website available,
- maintaining the Customer account,
- receiving Enquiries and Documentation,
- making quotations and Offers available,
- handling Orders and their statuses,
- communication between the Customer and Website staff.
Use of these electronic services is free of charge. A charge arises only for the performance covered by an accepted Order.
Use of the Website requires:
- a device with Internet access,
- an up-to-date web browser,
- support for JavaScript and cookies necessary for the operation of the Website,
- an active email address.
The Customer must protect their account access details and must not disclose them to unauthorised persons.
The Website must not be used for:
- submitting unlawful content,
- submitting malicious software,
- attempting to gain unauthorised access to the Website,
- disrupting its operation,
- knowingly submitting fictitious Enquiries or Orders.
The account is maintained for an indefinite period. The Customer may request closure of the account at any time by contacting the Operator.
Closing the account does not affect the obligation to perform contracts already concluded or obligations to retain documentation required by law.
The Operator may block an account in the event of a serious or repeated breach of the Terms, particularly unlawful use of the Website.
The Website is not a standard catalogue of ready-made products. Each Enquiry may be subject to individual technical and commercial assessment.
In an Enquiry, the Customer may specify, in particular:
- the material,
- the number of pieces,
- the desired date,
- the Documentation,
- required tolerances,
- surface or machining requirements,
- the delivery method,
- the information needed to prepare the sales document.
Submitting an Enquiry does not constitute an Order and does not create an obligation to pay.
The Customer is responsible for the accuracy and completeness of the Documentation supplied.
The Customer declares that they are entitled to use the Documentation supplied and to commission the manufacture of a part on that basis.
The Customer grants the Seller and necessary subcontractors the right to use the Documentation solely to the extent necessary for:
- preparing a quotation,
- checking technical feasibility,
- fulfilling the Order,
- quality control,
- handling complaints.
Providing Documentation does not transfer intellectual property rights in the Customer’s design to the Seller.
The Seller has the right to refuse to manufacture a part whose manufacture or possession would be unlawful or would require authorisations that the parties do not hold.
After reviewing the Enquiry, the Seller may present the Customer with an individual Offer.
The Offer may cover all or only selected parts submitted by the Customer.
The Offer may specify, in particular:
- the number of parts to be made,
- the material,
- the manufacturing method,
- the unit and total price,
- VAT,
- delivery costs,
- the expected completion date,
- additional technical conditions.
The Offer is valid for the period stated in it.
After the Offer expires, its acceptance may require renewed confirmation of the price and completion date, particularly because of changes in material prices or available production capacity.
In the event of an obvious clerical, calculation or technical error, the Seller will inform the Customer of the error. The effects of such an error after the contract has been concluded are assessed in accordance with applicable law.
Before placing an Order, the Customer receives a summary containing at least:
- the Seller’s details,
- the subject of the Order,
- the quantity,
- the price,
- taxes,
- delivery costs,
- the currency,
- the total amount payable.
The contract is concluded after the Customer uses the button:
“Order with obligation to pay”
and receives confirmation that the Order has been accepted by the system.
Until the moment referred to above, the Customer may decline the Offer without any obligation to pay.
Changing an Order after the contract has been concluded requires the Seller’s consent.
If a change affects the price, material, working time or completion date, the Seller may present a new quotation.
If production has already begun, the Seller is not obliged to accept a change to the Order.
Before an Order is placed, all prices are presented clearly and indicate the taxes due.
Payment is made using the method specified when placing the Order.
As a rule, performance begins after payment is credited or reliably confirmed.
The parties may individually agree on:
- an advance payment,
- partial prepayment,
- deferred payment,
- payment after completion.
In that case, the conditions specified in the Offer take precedence.
The sales document is issued by the Seller identified in the particular Order.
The Seller manufactures the part in accordance with the accepted Documentation and agreements.
If both a 3D model and a technical drawing have been provided, the dimensions, tolerances, threads, surface roughness and other requirements on the technical drawing take precedence over the nominal geometry of the 3D model, unless the parties expressly agree otherwise.
If a significant inconsistency is found in the Documentation, the Seller may suspend performance until clarification is obtained.
Before concluding the contract, the Customer should specify all material requirements, in particular:
- dimensional tolerances,
- geometrical tolerances,
- surface roughness,
- the material and its grade,
- hardness,
- heat treatment,
- coatings,
- surface appearance requirements.
Failure to specify a requirement that cannot be inferred from the Documentation or Offer does not automatically mean that the Seller has undertaken to meet it.
The Seller is responsible for conformity of the work with the Order, but not for the structural adequacy of the design supplied by the Customer or its suitability for a particular application, unless the Order also included designing or verifying that solution.
Manufacturing a part in accordance with Customer Documentation does not constitute certification, type approval or confirmation of the safety of the design.
This applies in particular to parts intended for vehicles, machines, lifting equipment, pressure installations and other applications where failure may cause harm.
The Seller may refuse to manufacture a part if there are reasonable doubts about the lawfulness of the Order or the safety of its performance.
Unless the Offer states otherwise, the Seller selects a machining technology that enables the part to be made in accordance with the Documentation.
Normal marks resulting from the production process, particularly tool marks, clamping marks or standard deburring marks, do not in themselves constitute non-conformity, provided they do not breach the agreed dimensions, tolerances, properties or surface requirements.
Aesthetic requirements or requirements for a decorative surface should be specified before the Order is placed.
Minor differences in appearance resulting from the material batch or manufacturing process do not constitute non-conformity if the specific appearance parameter was not included in the Order and does not affect the agreed properties of the part.
If machining is performed on material supplied by the Customer, the Customer should provide accurate information about the material’s grade and properties.
The Seller may refuse to machine material which, in the Seller’s assessment:
- is unsuitable for the required technology,
- may damage machines or tools,
- does not correspond to the declared material.
The Seller is not liable for the consequences of hidden defects in supplied material that could not reasonably have been detected before machining began.
If such a hidden defect makes manufacture of the part impossible, the parties will agree on how to proceed.
The Seller may use subcontractors, in particular for:
- additional machining,
- heat treatment,
- anodising, galvanising or other coatings,
- inspection or measurement,
- transport.
Entrusting part of the work to a subcontractor does not change the entity that is a party to the contract with the Customer.
Unless the Offer states otherwise, the time specified in the Offer is calculated from:
- receipt of the required payment and
- receipt of complete Documentation and the required agreements.
If additional information from the Customer proves necessary during performance, the completion date may be postponed accordingly by the time spent awaiting the Customer’s response.
If a circumstance beyond the Seller’s control arises that may significantly delay performance, the Seller will inform the Customer.
The above provision does not restrict the Consumer’s statutory rights arising from delay or non-performance of the contract.
The Order may be:
- sent by a carrier, or
- collected in person.
The delivery cost is stated before the Order is placed.
Where possible, the Consumer should check the condition of the shipment upon receipt.
Identifying shipment damage and preparing a report with the carrier may facilitate pursuing claims; however, the absence of a report does not deprive the Consumer of their rights.
For a Consumer, the risk of accidental loss of or damage to the goods passes in accordance with applicable law.
In business-to-business relationships, unless the individual Offer states otherwise, the risk associated with the shipment passes to the Customer when the shipment is handed over to a professional carrier.
A Consumer concluding a distance contract generally has the right to withdraw from the contract within 14 days without giving any reason.
This right does not apply in cases specified by law.
In particular, the right of withdrawal does not apply to non-prefabricated goods made to the Consumer’s specifications or to meet their individual needs.
A CNC part made on the basis of an individual model, drawing, dimensions or other individual Customer requirements may constitute such goods.
Exclusion of the right of withdrawal does not restrict the Consumer’s right to complain about a part that does not conform to the contract.
If the contract concerns only a service and the Consumer requests that it begin before the withdrawal period expires, the relevant rules on beginning service provision early apply.
If the Consumer validly withdraws from a contract for which they have a right of withdrawal, they may use the form below, although using this model is not mandatory.
Recipient: the Seller identified in the Order.
“I hereby give notice of withdrawal from contract no. [numer zamówienia], concluded on [data], concerning [przedmiot]. Full name: [dane], address: [adres], date: [data].”
The Seller is liable to the Consumer for conformity of the goods with the contract under the rules of the Polish Consumer Rights Act.
A complaint may be sent:
by email to: info@majkocnc.eu
or in writing to the Seller’s address stated in the Order.
To facilitate handling a complaint, it is helpful to provide:
- the Order number,
- a description of the identified non-conformity,
- the Customer’s requested remedy,
- photographs or measurement results, where possible.
The absence of a photograph, measurement report or receipt is not in itself grounds for refusing to accept a Consumer’s complaint.
If necessary to assess the complaint, the Seller may ask for the part concerned to be made available.
The Seller will respond to the Consumer’s complaint within 14 days of receiving it.
The Consumer’s rights, including the right to repair, replacement, a price reduction or, in cases provided for by law, withdrawal from the contract, arise from applicable law.
The provisions of these Terms concerning Consumers also apply to a natural person conducting business to the extent that applicable law grants them consumer rights because the particular contract is not of a professional nature.
If the nature of the contract is not clear from its terms, a Customer who is a natural person conducting business may submit an appropriate declaration in accordance with applicable law.
The Customer is not required to submit such a declaration as a condition of entering into the contract.
The provisions of this section apply exclusively to Customers conducting business who do not benefit from consumer protection in relation to the particular contract.
A Business Customer must inspect the manufactured parts to the extent customary for goods of this kind and promptly inform the Seller of any identified non-conformities.
Unless the individual Offer states otherwise, the Seller’s statutory warranty liability for defects towards a Business Customer is excluded to the extent permitted by law.
The above does not exclude the Seller’s liability for fulfilling an Order contrary to the expressly agreed Documentation.
The Seller is not liable to a Business Customer for:
- lost profits,
- loss of production,
- loss of contracts,
- downtime,
- indirect or consequential losses,
unless exclusion of liability would be impermissible in the particular case under mandatory law.
The Seller’s total liability for damages towards a Business Customer in connection with a particular Order is limited to the net value of that Order, except for intentionally caused damage and other cases where limiting liability is not permitted by law.
The Seller is not liable for the consequences of using a correctly manufactured part in a structure designed by the Customer or a third party where the cause of the damage is the design, selection of the part or the way it is used, rather than a manufacturing defect in the part.
Complaints concerning electronic services, the account, the Enquiry form or operation of the panel may be sent to:
info@majkocnc.eu
Where possible, the complaint should contain information that enables the problem to be identified.
The Operator will handle the complaint without undue delay and no later than within 14 days.
The Operator may temporarily restrict access to the Website for:
- maintenance,
- updates,
- resolving faults,
- ensuring the security of the Website.
The Operator takes reasonable steps to ensure continuity of the Website’s operation but does not guarantee a complete absence of failures or technical interruptions.
The above provision does not exclude Customer rights arising from mandatory law.
The Consumer may use out-of-court methods of complaint handling and pursuing claims.
Information on available consumer assistance and amicable dispute resolution is available, among others, through the Polish Office of Competition and Consumer Protection, the relevant consumer ombudsmen and the Trade Inspection.
Participation in out-of-court proceedings is voluntary unless applicable law provides otherwise.
Contracts concluded under these Terms are governed by Polish law.
For a Consumer, this provision does not deprive them of the protection afforded by mandatory law.
Disputes with Consumers are resolved by courts having jurisdiction under applicable law.
For disputes between the Seller and a Business Customer, the court with territorial jurisdiction over the Seller’s registered office has jurisdiction, unless the parties individually agree otherwise.
The Operator may amend the Terms for an important reason, particularly as a result of:
- changes in the law,
- changes to the way the Website operates,
- the introduction of new features,
- changes to payment methods or the placing of Orders,
- the need to improve Website security.
A particular Order is subject to the version of the Terms in force and made available to the Customer when the contract was concluded.
Amendments to the Terms do not affect rights acquired under contracts concluded previously.
If any provision of the Terms proves invalid or ineffective, this does not affect the validity of the remaining provisions.
